FlipTips (ABN 84 553 484 170) ("FlipTips", "we", "us", "our"), based in Queensland, Australia, owns and operates the fliptips.com.au website (the "Website") and the FlipTips Android application (the "App") (together, "FlipTips" or the "Service"). Your use of the Service is governed by these terms ("Terms"). By using the Website or App you are taken to have read, understood and accepted these Terms. If you do not agree to these Terms, you must stop using the Service.
1.1 The Services provided via FlipTips are:
(a) Single Tip Unlock - a one-off purchase revealing one horse racing tip (one card) for that day; and
(b) Day Pass - a one-off purchase unlocking all of that day's tips. Both are digital content, delivered immediately. There are no subscriptions, no recurring charges, and no accounts.
1.2 The Service is not a bookmaking or wagering service. No bets are received, placed, executed or facilitated by us; we hold no wagering money; and the Service contains no bookmaker links, advertising or affiliate arrangements.
1.3 FlipTips does not give financial advice. Tips are our opinion, provided for entertainment and informational purposes only.
1.4 By using the Service you confirm that you are 18 years of age or older.
1.5 While we stand behind our form, no tip is a guarantee. Betting is a form of gambling; it is risky, and you can lose your entire stake. FlipTips is not responsible for any betting losses you incur and will not provide refunds in respect of gambling money lost with any wagering operator. (Refunds for the tips themselves are dealt with in section 6.)
1.6 FlipTips is an advocate of responsible gambling. You should be in control of your gambling at all times and not allow your gambling to control you. If you choose to follow a tip, do so in a controlled way, and only ever gamble what you can afford to lose. Support resources are on our Disclaimer page.
2.1 We may amend these Terms from time to time. Where amendments are material, we will give reasonable notice by publishing the amended Terms on the Website before they take effect. Continued use of the Service after amendments take effect means you accept them. Changes do not affect purchases already made.
3.1 On the Website, payments are processed by Stripe; on the App, by Google Play Billing. We never see or store your card details. The price shown at checkout is the price you pay. Payments are in Australian dollars.
3.2 Tips relate to scheduled races. Once a tip's race has been run or is closed, that tip is no longer offered for sale. A Day Pass reveals the day's tips that are still open when you first reveal them; once a tip has been revealed to you, it remains available to you for the rest of that day.
4.1 We give no assurance that a race or runner that is the subject of a tip will not be scratched, cancelled, postponed or otherwise varied - these decisions belong to racing authorities and happen without notice.
4.2 However, if the horse in a Single Tip Unlock you purchased is scratched before its race is run, contact admin@fliptips.com.au and we will refund that purchase. For Day Passes (which cover the whole day's tips), we will consider a fair remedy case by case.
5.1 The Website has no accounts. When you buy an unlock, we remember your purchase in your browser for the rest of that day, and we also email you a backup access link so you can restore access if needed - for example, if you clear your browser data or switch devices. Access expires at the end of the day it was purchased for (Australian Eastern time).
5.2 To prevent abuse, the emailed link can only be used a limited number of times. If you lose access to something you paid for, contact admin@fliptips.com.au and we will put it right.
6.1 Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms limits those rights.
6.2 Because unlocks are digital content delivered immediately, we do not offer refunds for a change of mind after a tip has been revealed.
6.3 If something has gone wrong on our side - you paid and did not receive access, you were charged in error, the Service was not as described, or your tipped horse was scratched (section 4.2) - contact admin@fliptips.com.au and we will fix it, including refunding you where the Australian Consumer Law requires or where we consider it fair. Refunds are made to the original payment method.
6.4 For App purchases, Google Play's refund process also applies and may be the fastest path.
6.5 For clarity, and as set out in section 1.5: money you bet with any wagering operator is not money paid to us, and we do not refund betting losses.
7.1 The tips you unlock are provided for your personal use only. They are confidential and proprietary to us and must not be forwarded, shared, posted, sold or otherwise communicated to any other person or platform without our prior written consent. The access-link use limits in section 5.2 exist to protect this.
8.1 You must not misuse the Service, including: attempting to bypass the paywall; scraping, harvesting or republishing content; interfering with the Service's operation or security; or using the Service for any unlawful purpose. We may suspend access we reasonably believe is abusive.
9.1 We own or license all rights in the Service and its content - including the FlipTips name, logo, design, and the tips themselves. We grant you a licence to access the Service and view content for personal, non-commercial use on these Terms. No other rights are granted or transferred.
10.1 If you send us feedback (suggestions, comments, reviews or ideas), you grant us a non-exclusive, royalty-free, perpetual licence to use it to operate and improve the Service, without compensation to you.
11.1 To the maximum extent permitted by law - and without limiting your rights under the Australian Consumer Law - we exclude liability for indirect, incidental or consequential loss arising from the Service, including any wagering losses incurred after using information from the Service. Where our liability cannot be excluded but can be limited, it is limited, at our option, to re-supplying the relevant content or refunding the amount you paid for it.
12.1 If we fail to exercise, or delay in exercising, any right under these Terms, that is not a waiver of it, and acting on one breach does not waive our rights over any other breach.
13.1 If any part of these Terms is found illegal, invalid or unenforceable in a jurisdiction, it is severed for that jurisdiction and the remaining provisions continue in full force.
14.1 These Terms and your use of the Service are governed by the laws in force in Queensland, Australia, and you submit to the non-exclusive jurisdiction of the courts exercising jurisdiction in Queensland.
